California’s Departments of Agriculture has certified, registered, and regulated the growing of industrial hemp in conformance with federal and state laws, rules, and regulations (California Food and Agricultural Code, Division 24, §81001). On May 28, 2019, USDA’s Office of the General Counsel issued a memorandum that concluded:
– Hemp has been removed from schedule I of the Controlled Substances Act and is no longer a controlled substance
– States and Indian tribes may not prohibit the interstate transportation or shipment of hemp lawfully produced under a State or Tribal plan or under a license issued under the USDA plan. Additionally, States and Indian tribes also may not prohibit the interstate transportation or shipment of hemp lawfully produced under the 2014 Farm Bill.

According to 7 U.S.C §1639o, the term “industrial hemp” “means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.” Our “industrial hemp” has a Delta-9 THC level of 0%.
